Simply put, patent claims are very precise descriptions of an invention--the fundamental attributes of an invention, that is. These specific attributes are the inventor's legal "claim" to own new intellectual property, just as a miner files a claim on a specific piece of real property. Essentially, the claims are the invention. And they will be the primary descriptions examined in a court of law to determine if a new device has infringed the patent. Careful claim writing will result in a strong patent that protects an invention for many years. Misguided claim writing can result in a patent that is totally worthless.

Robert M. Hunter, PhD, PE, PLLCAs a special guest speaker for a Patenting Workshop Dr. Hunter addressed this crucial aspect of preparing a patent application--drafting broad claims. These audio cassettes are a recording of his presentation. For almost two full hours Dr. Hunter explains in a clear and understandable style the general, as well as, the finer points of claim writing.

As Dr. Hunter explains, it is very important for an inventor to understand effective claim writing--even if using the services of a patent attorney. Ultimately, it is the inventor's responsibility to be certain that a truly effective patent is obtained. If the patent is going to have "teeth" in it the inventor will need to thoroughly "teach the invention" to the the patent attorney. Dr. Hunter explains why it is a very good idea to present the attorney with good drafts of what the patent claims might look like.

Many actual examples are cited throughout the presentation to clearly illustrate concepts, techniques, and tips. And workshop participants ask several questions that lead to even more practical advice.

About the Presenter...

Robert M. Hunter, PhD, PE, PLLC , is a professional inventor and principal investigator for YES Technologies, Inc. in Bozeman, Montana (and a registered patent agent since 1998). He received his BS degree in civil engineering from Stanford University, a MS degree in environmental engineering from the University of California, Berkeley, and a PhD in public health/environmental engineering from Montana State University. He has been project manager for numerous research and engineering investigations.

Hunter, PhD, PE, PLLCDr. Hunter's honors include: 1992-1993 Who's Who of American Inventors; 1993 R&D 100 Award for DataGator(TM) flow metering system; 1992 R&D Award for WiseCap(TM) elder-accessible child-resistant packaging and the Tech/cellence Award from SBIR West. Dr. Hunter obtained his early patents by working with some of the most qualified and experienced patent attorneys in the field. To this "patent law education" he added much independent study and a great deal of personal experience--preparing, filing, and prosecuting his patent applications with the US Patent and Trademark Office. He has been granted numerous patents and has many patents pending. Since 1982 Hunter has been assisting inventors and innovative organizations prepare, file and prosecute patent applications. In 1998 Hunter opened his practice as a registered patent agent.

Subject matter of Dr. Hunter's patents range from child-resistant medicine containers and buckles to biotechnological treatments of hazardous waste. His patents have led to licensing agreements with major corporations.
